Public Offer for the Provision of Access Services to the eRisk-Control Service
The document, the provisions of which are set out below, constitutes a public offer and a public contract. In accordance with Articles 633 and 641 of the Civil Code of Ukraine, the terms of a public offer and a public contract are the same for all customers.
Pursuant to Part 2 of Article 642 of the Civil Code of Ukraine, registration on the website https://eriskcontrol.com/en/signup
constitutes acceptance of this offer and is equivalent to concluding a contract on the terms set out below, as well as the provisions of the Privacy Policy. The Privacy Policy governs the processing of Customers’ personal data by the Contractor and forms an integral part of these Terms.
This public offer is addressed to all individuals and legal entities who wish to use the service and have the technical capability to receive it.
LIMITED LIABILITY COMPANY “RAMOSE”, EDRPOU code 41425207 (hereinafter referred to as the Contractor), acting in accordance with the laws of Ukraine, offers an individual or legal entity (hereinafter referred to as the Customer) to conclude a public contract for the provision of services on the following terms.
1. Terms and Definitions
1.1. Public offer (contract) — an offer of the Contractor addressed to any individual and/or legal entity to conclude a public contract for access to the eRisk-Control service.
1.2. Acceptance — the Customer’s full and unconditional consent to conclude this Agreement on the terms specified herein.
1.3. Contractor — LIMITED LIABILITY COMPANY “REIMOS”, EDRPOU code 41425207, legal address: Ukraine, 02140, Kyiv, Petra Hryhorenka Avenue, building 39B.
1.4. Service — eRisk-Control.
1.5. Customer — an individual and/or legal entity that has agreed to these Terms and the Privacy Policy and has registered in the manner established by the eRisk-Control service.
1.6. Services — provision by the Contractor of access to the eRisk-Control service on a paid or free basis after registration.
1.7. Paid services (professional tariff) — services provided by the Contractor for a fee, in the scope chosen by the Customer.
1.8. Free services (open tariff) — limited access to information and search functionality on the Service, the scope of which is determined by the Contractor at its discretion.
1.9. Test period — a period starting from one calendar day after registration, during which the Customer receives free basic access.
1.10. Cost of services (tariff) — the payment amount established by the Contractor for access to the Service.
1.11. Scope of services — functionality, capabilities and content available under a specific tariff plan.
1.12. Tariff plan — terms defining the scope of services and duration of access (e.g. 3, 6, 12 months).
1.13. Personal data — information relating to an identified or identifiable individual.
1.14. Personal data subject — an individual whose personal data is processed.
1.15. Consent of the personal data subject — voluntary permission to process personal data. Registration implies such consent.
1.16. Account — a set of information about the Customer provided during registration.
2. General Provisions
2.1. Access to the Service is provided only after registration and account creation on https://eriskcontrol.com/en/signup.
2.2. Services may be provided on a paid or free basis at the Customer’s choice.
2.3. All amendments to this Agreement are published on the Contractor’s website.
2.4. These Terms are binding on both Parties. If the Customer disagrees, they must not use the Service.
2.5. In case of disagreement with amendments or new tariffs, the Customer must stop using the Service.
2.6. By registering, the Customer consents to the processing of personal data and receipt of service-related communications.
3. Procedure for Provision of Services
3.1. The Customer independently registers on the website and automatically receives access.
3.2. Access to the Service as software is exempt from VAT under the Tax Code of Ukraine.
4. Account
4.1. To use the Service, the Customer must create an Account by:
- providing first name, last name and email address; or
- logging in via Google.
4.2. The Customer confirms legal capacity and accuracy of provided information.
4.3. Personal data processing is governed by the Privacy Policy.
5. Rights and Obligations of the Parties
5.1. Contractor’s Obligations
- provide services in accordance with the selected tariff;
- ensure confidentiality of personal data;
- provide electronic acceptance certificates upon request.
5.2. Contractor’s Rights
- terminate paid services upon expiration;
- change tariffs and service procedures;
- disclose information as required by law.
5.3. Customer’s Obligations
- timely payment for paid services;
- comply with these Terms;
- not resell or transfer service results;
- keep login credentials confidential;
- not collect or parse data from the Service.
5.4. Customer’s Rights
- receive information on services and tariffs;
- use the Service within the selected tariff;
- contact the Contractor for support and documentation.
6. Cost of Services and Payment Procedure
6.1. Prices are determined by tariff plans published on the website.
6.2. Payment is made by non-cash transfer.
6.3. Services are provided after 100% prepayment.
6.4. The Customer is responsible for payment accuracy.
7. Service Information
7.1. The Service may contain analytical and informational materials.
7.2. Data may be obtained from open and official third-party sources.
7.3. The Contractor is not responsible for the accuracy of third-party data.
7.4. Analytical materials are informational and not legal advice.
8. Liability of the Parties
8.1. The Contractor is not liable for accuracy of analytical data.
8.2. The Customer uses information at their own risk.
8.3. The Contractor is not liable for damages arising from use or inability to use the Service.
8.4. In case of violations, access may be restricted or terminated.
9. Dispute Resolution Procedure
9.1. These Terms are governed by Ukrainian law; GDPR applies to EU users.
9.2. Disputes are resolved through negotiations.
9.3. If unresolved within 30 days, disputes are referred to a competent court in Ukraine.
10. Intellectual Property Rights
10.1. All Service components belong to the Contractor.
10.2. Commercial use without written permission is prohibited.
11. Contact Details and User Support
The Customer may contact the Contractor regarding:
- technical access issues;
- payments and tariffs;
- acceptance certificates;
- account deletion;
- other service-related matters.
Requests are processed within 10 business days.
12. Final Provisions
12.1. The Parties agree to use electronic digital signatures.
12.2. The Customer may terminate these Terms by deleting the Account.
12.3. Continued use of the Service after amendments constitutes acceptance of the updated Terms.
