Terms of Service

Welcome to eRisk-Control, a web application operated by Ramose LLC (“we,” “us,” or “our”), a company registered in Ukraine. eRisk-Control provides AI-generated risk assessments for workplaces, work types, and professions. These Terms of Service (“Terms”) govern your use of eRisk-Control (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service is intended for adult users, particularly those in professional or workplace settings. If you are an EU resident, you may also have rights under your local consumer protection laws, which these Terms do not limit.

2. Account Registration

To use the Service, you must create an account using your email address or Google OAuth. You agree to:

• Provide accurate, current, and complete information, including your full name and, optionally, phone number.
• Maintain the security of your account credentials and accept all risks of unauthorized access.
• Notify us immediately of any unauthorized use of your account at ramose.group@gmail.com.

3. User Conduct

You agree not to:

• Submit content (e.g., profile images, descriptions of professions, work types, workplaces, or AI chat messages) that is offensive, obscene, defamatory, unlawful, or otherwise inappropriate.
• Use the Service to harass, threaten, or harm others.
• Engage in any activity that interferes with or disrupts the Service.
• Violate any applicable laws, including Ukrainian law and, for EU residents, EU regulations.

4. User-Generated Content

You may submit textual information about professions, work types, workplaces, and messages in the AI chat feature, as well as a profile image (“User Content”). By submitting User Content, you:

• Grant us a worldwide, non-exclusive, royalty-free license to use, store, and transmit such content to provide the Service, including sharing it with our third-party AI service provider for generating risk assessments.
• Represent that your User Content complies with these Terms and does not infringe on any third-party rights. We reserve the right to remove any User Content that violates these Terms.

5. AI-Generated Risk Assessments

The Service uses artificial intelligence (AI) to generate risk assessment files based on your input. You acknowledge that:

• AI-generated content may not be fully accurate or complete.
• Ramose LLC is not liable for any errors, omissions, or consequences arising from your reliance on AI-generated risk assessments, to the extent permitted by applicable law.
• Risk assessments are provided for informational purposes only and should not be considered professional advice.

6. Intellectual Property

The Service, including its software, design, and AI-generated templates, is owned by Ramose LLC or its licensors and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works from the Service without our prior written consent.

7. Access and Billing

Access to the Service is managed through agreements between Ramose LLC and its clients, with billing handled outside the Service (e.g., via invoices). No in-app payments are processed.

8. Termination

We may suspend or terminate your account if you:

• Fail to accept the latest version of these Terms.
• Violate any provisions of these Terms, including submitting inappropriate content. Upon termination, your right to use the Service will cease immediately. You may request account deletion by contacting ramose.group@gmail.com.

9. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied, except as required by EU consumer law for EU residents. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for your purposes.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Ramose LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including reliance on AI-generated risk assessments. EU residents may have additional rights under local consumer protection laws that cannot be waived.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ukraine, without prejudice to mandatory consumer protection laws applicable to EU residents. Any disputes arising under these Terms shall be resolved through binding arbitration in Kyiv, Ukraine, in accordance with the rules of the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry. EU residents may also use the EU’s Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) or pursue remedies in their local courts, as required by EU law.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email to the address associated with your account at least 30 days before they take effect, in accordance with EU requirements. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
